Terms and conditions

The terms that apply to all quotations, assignments and agreements of the Afghan Interpreting and Translation Agency (ATV-bureau).

Article 1 – Definitions

ATV-bureau: Afghan Interpreting and Translation Agency, a sole proprietorship. Client: any natural or legal person who places an order for interpreting and/or translation services.

Article 2 – Applicability

These terms apply to all quotations, assignments and agreements of ATV-bureau. Deviations are only valid if agreed in writing.

Article 3 – Quotations and agreements

All quotations are without obligation. An agreement is formed once a quotation is accepted or as soon as ATV-bureau begins the work.

Article 4 – Performance of the assignment

ATV-bureau performs its work to the best of its insight and expertise. The client provides all necessary information and documents in good time.

Article 5 – Rates and payment

Rates are determined on the basis of a quotation. Invoices must be paid within 14 days of the invoice date. In the event of late payment, statutory interest and collection costs are due.

Article 6 – Cancellation

If an assignment is cancelled less than 24 hours before the agreed time, the client owes the full agreed invoice amount. In the case of earlier cancellation, only work already performed is charged.

Article 7 – Delivery and deadlines

Stated deadlines serve only as an indication and are not to be regarded as strict deadlines.

Article 8 – Complaints

Complaints must be reported in writing within 7 days of delivery. Submitting a complaint does not suspend the payment obligation.

Article 9 – Liability

ATV-bureau is not liable for direct or indirect damage, consequential loss, lost profit or other damage arising from the performance of the assignment. If liability is nevertheless established, it is limited to no more than the invoice amount of the relevant assignment. The client indemnifies ATV-bureau against third-party claims.

Article 10 – Confidentiality

ATV-bureau treats all information provided as confidential, unless a legal obligation requires otherwise.

Article 11 – Force majeure

ATV-bureau is not obliged to fulfil obligations in the event of force majeure, including illness, malfunctions, calamities or government measures.

Article 12 – Privacy (GDPR)

  • 12.1 ATV-bureau processes personal data only to the extent necessary for the performance of the agreement and in accordance with the General Data Protection Regulation (GDPR).
  • 12.2 Personal data is not kept longer than necessary for the purpose for which it was collected or for as long as a statutory retention obligation applies.
  • 12.3 ATV-bureau does not provide personal data to third parties, unless this is necessary for the performance of the assignment or is legally required.
  • 12.4 The client has the right to access, rectify, erase and restrict the processing of their personal data to the extent permitted by law.

Article 13 – Applicable law and disputes

Dutch law applies to all agreements. Disputes are submitted to the competent court in the Noord-Holland district.

Article 14 – Amendment of terms

ATV-bureau reserves the right to amend these terms. The most recent version always applies.
